Acceptance of Terms

By accessing or using the Straight Blast Gym of Bend, LLC (hereafter “Company,” “we,” or “us”) website (“Site”), you agree to be bound by these Terms of Use. If you do not agree to all of the terms, then you may not access or use the Site.

Use of Our Services

You agree not to use the Site for any unlawful purpose or any purpose prohibited under this clause. You further agree not to use the Site in any way that could damage the Site, the services, or the general business of the Company.

Limitations of Liability

To the maximum extent permitted by law, in no event shall Company be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use or alteration of your transmissions or content.

Under no circumstances shall the aggregate liability of the Company exceed the amount you have paid the Company in the prior six months leading up to the event giving rise to the liability.

Indemnification

You agree to defend, indemnify and hold harmless the Company, its subsidiaries and affiliates, and their respective directors, officers, employees and agents from and against all claims, suits, demands, losses, liabilities, damages, costs and expenses, including attorneys’ fees, arising out of or in any way connected with your use of the Site or violation of these Terms of Use.

Governing Law

These terms shall be governed by and interpreted in accordance with the laws of the State of Oregon, without regard to conflict-of-law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in or nearest to Bend, Oregon, for the resolution of any disputes.

Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of or access to the Site following the posting of any changes to these Terms constitutes acceptance of those changes.
